By using the website or submitting information through it, you agree to these Terms. If you do not agree, you should not use the website.
In these Terms, "KyHealth", "we", "us" and "our" means [insert legal entity name] and, where the context requires, our authorised staff, clinical providers, technology providers and partner pharmacies involved in providing the relevant service.
KyHealth provides or coordinates digital health services that may include online pre-screening, appointment booking, telehealth consultation support, prescription coordination, pharmacy fulfilment and delivery support.
KyHealth service categories may include skin health and skin cancer check pathways, weight loss and metabolic health pathways including GLP-1 related care where clinically appropriate, women's hormone health and HRT related pathways, hair loss and scalp health pathways, medicinal cannabis services through third parties where lawful and clinically appropriate, and other services added from time to time.
Not all services are suitable for all patients. Access to consultation, prescription, pharmacy supply or delivery is always subject to clinical review, professional judgement, legal requirements, service availability and patient suitability.
Information on this website is general in nature and is not a substitute for individual medical advice, pharmacist advice, diagnosis, treatment, pathology interpretation, urgent care or emergency care.
You should speak with a pharmacist, doctor, nurse practitioner or another appropriately qualified health practitioner about your individual circumstances.
We may update website content at any time. Although we aim to keep information accurate and current, medicine availability, pricing, clinical guidelines, eligibility criteria, delivery options and regulatory requirements can change.
⚠️ KyHealth is not an emergency service. Do not use this website for urgent or life-threatening symptoms. If you have chest pain, severe shortness of breath, signs of stroke, severe allergic reaction, suicidal thoughts, severe bleeding, sudden severe pain, rapidly worsening symptoms or any emergency — call 000 or attend the nearest emergency department.
If you are unsure whether your symptoms are urgent, seek immediate advice from a local health service, pharmacist, GP, urgent care clinic, hospital or emergency service.
Pre-screening questionnaires are designed to help KyHealth understand your needs and guide you towards an appropriate next step. A pre-screening result is not a diagnosis, prescription, approval for treatment or guarantee that a consultation, prescription or medicine will be provided.
You agree to provide accurate, complete and up-to-date information. We may decline or delay a booking, consultation, prescription pathway, pharmacy service or delivery if information is incomplete, inconsistent, unsafe, suspicious or clinically unsuitable.
Some answers may trigger clinical review before a booking is confirmed or before any treatment options are discussed.
Bookings may be delivered by nurse practitioners, doctors, pharmacists or other suitably qualified health practitioners, depending on the service.
Clinical practitioners are responsible for exercising their own professional judgement. KyHealth does not guarantee that a practitioner will prescribe a medicine, recommend a particular treatment, approve a request or consider a service suitable for you.
You are responsible for being available at the booked time, providing accurate contact details, completing required forms and supplying any requested information before the appointment.
Consultation fees, cancellation rules and rescheduling rules will be displayed or communicated to you before or during the booking process where practical.
You may submit prescription information through an electronic prescription token, paper prescription details, an Active Script List request or other approved process. Where a hard copy prescription is legally required, the pharmacy must receive it before medicine is supplied.
Submitting an order or payment does not mean that a medicine will be supplied. Supply is subject to receipt of a valid prescription where required, identity checks, pharmacist review, clinical appropriateness, stock availability, legal and regulatory requirements, payment of applicable fees and any additional checks required for monitored medicines, controlled medicines, cold-chain items, compounded medicines, unapproved therapeutic goods or high-risk medicines.
We or a partner pharmacy may refuse, delay or cancel supply where it is considered unsafe, inappropriate, unlawful, incomplete, clinically unsuitable, suspicious, inconsistent with professional obligations, or where required information has not been provided.
If you provide an electronic prescription token, you confirm that you are the patient, the patient's authorised agent, carer, parent or legal guardian, or otherwise authorised to provide that prescription to us or a partner pharmacy.
If you ask us or a partner pharmacy to access your Active Script List, you consent to that access for the purpose of providing pharmacy or prescription related services to you.
You must not forward, upload or submit prescription tokens that you are not authorised to use.
All medication requests are subject to pharmacist review. A pharmacist may contact you, your prescriber or another member of your treating team to clarify medication, dose, indication, allergies, interactions, repeat intervals, treatment plan or other relevant matters.
A pharmacist may decline supply even where payment has been made. If supply is declined and no medicine or relevant service has been provided, we will refund the relevant amount, subject to any lawful fees already incurred and your rights under the Australian Consumer Law.
Some medicines are subject to additional legal, professional and safety requirements. This may include Schedule 8 medicines, certain Schedule 4 monitored medicines, medicinal cannabis products containing THC and other medicines with misuse, dependence or diversion risks.
We or a partner pharmacy may check relevant prescription monitoring systems, including ScriptCheckWA where applicable, and may require additional information, identification, prescriber confirmation or clinical review before dispensing these medicines.
We may decline, delay or limit supply of monitored or controlled medicines if required or permitted by law or professional obligations.
Medicinal cannabis services may be provided through third-party prescribers, clinics or pharmacies where lawful and clinically appropriate. KyHealth does not guarantee access to medicinal cannabis or any particular product.
Most medicinal cannabis products are not registered on the Australian Register of Therapeutic Goods and may require access through pathways such as the Special Access Scheme or Authorised Prescriber Scheme.
For medicinal cannabis or other unapproved therapeutic goods, we or a partner pharmacy may require a valid prescription specifying the exact product, formulation, strength and directions, confirmation of applicable TGA or Authorised Prescriber access, State or Territory authorisation where required, identity confirmation, prescription monitoring checks, confirmation of repeat intervals and maximum daily dose, and prescriber clarification where required.
We do not guarantee that a particular medicinal cannabis product or unapproved therapeutic good is available, suitable, lawful to supply, clinically appropriate, covered by any subsidy or able to be delivered to your location.
Information about weight loss, GLP-1 medicines, hormone therapy, hair loss treatments and skin health services is general and does not guarantee suitability, diagnosis, treatment or prescription.
These services may require clinical assessment, medical history review, contraindication screening, pregnancy or breastfeeding screening, medication interaction review, pathology, in-person examination, imaging, referral to another practitioner or ongoing monitoring.
Some treatments may not be suitable for you, may require further assessment, may be unavailable, may have risks or side effects, or may require a different care pathway than the one you initially requested.
For skin health and skin cancer check services, online assessment may not replace an in-person skin examination, biopsy, dermoscopy or specialist review where clinically required.
All medicines and products are subject to stock availability. Product names, brands, strengths, pack sizes and pricing may change.
Partner pharmacies may provide stock catalogues to assist with prescription and fulfilment alignment. These catalogues are operational aids and do not guarantee that a medicine will be available at the time of dispensing.
Where clinically appropriate and legally permitted, a pharmacist may offer a generic or brand substitution. Some medicines cannot be substituted. We will seek your consent or prescriber clarification where required.
Where available, Consumer Medicine Information may be provided as a link, PDF or printed information by the relevant pharmacy, manufacturer or trusted medicine information source.
You should read the label and Consumer Medicine Information and follow advice from your prescriber and pharmacist. Contact a pharmacist or prescriber if you have questions or concerns about a medicine.
We will advise you of applicable amounts before supply where practical. Prices may change due to supplier pricing, PBS rules, private pricing, stock availability, brand changes, wholesaler costs, special access product pricing, delivery method or pharmacy pricing.
Payment does not guarantee supply. If a medicine cannot be supplied and no alternative is agreed, we will refund the relevant amount, subject to your rights under the Australian Consumer Law.
We may use third-party payment providers, including secure payment links, to process payments. You must provide accurate payment information and must not use a payment method without authorisation.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
We do not provide refunds merely because you change your mind, or no longer want a medicine that has been correctly dispensed, except where required by law.
For safety and quality reasons, dispensed medicines generally cannot be returned for resale or re-supply once they have left the pharmacy. You may return unwanted medicines to a pharmacy for safe disposal.
Nothing in these Terms limits your rights under the Australian Consumer Law.
Depending on your location, the pharmacy partner, medicine type and service availability, delivery options may include local delivery, courier, Australia Post, express post, signature on delivery or pharmacy collection.
Delivery options are subject to medicine suitability, legal requirements, weather, temperature requirements, courier availability, stock availability and pharmacist approval.
Some medicines may not be suitable for postage or delivery. This may include refrigerated medicines, urgent medicines, fragile items, controlled medicines, high-value medicines, high-risk medicines or medicines where delayed delivery may create a safety risk.
You may receive confirmation or tracking information by SMS, email or another electronic method where available.
Delivery timeframes are estimates only unless we expressly agree otherwise. Delays may occur due to incomplete information, invalid prescriptions, prescriber delays, stock shortages, wholesaler delays, regulatory checks, payment issues, incorrect delivery details, weather events, courier delays or circumstances outside our reasonable control.
You are responsible for providing accurate delivery details. If a parcel cannot be delivered because the address is incorrect, no authorised person is available, identity checks fail, delivery is refused or the parcel is not collected, additional delivery or replacement fees may apply.
If medicine is returned, the pharmacist will assess whether it can be safely supplied again. Some medicines may need to be destroyed if storage, temperature control or integrity cannot be confirmed.
If your delivery is lost, damaged, opened, delayed, exposed to unsuitable conditions or appears tampered with, contact us promptly and do not use the medicine until a pharmacist or authorised person advises you.
We will assess the issue and provide a remedy where required by law, which may include replacement, refund, re-supply or another appropriate action.
Some medicines require refrigeration or temperature-controlled handling. Cold-chain medicines may require special packaging, express delivery, same-day delivery or collection.
We or a partner pharmacy may decline to post cold-chain medicines where the delivery route, timing or temperature risk is considered unsuitable.
You are responsible for promptly receiving and storing cold-chain medicines as directed. If a cold-chain medicine cannot be delivered because no authorised person is available, or the medicine is redirected, held, returned, delayed or stored by a carrier or collection point, the pharmacist may be unable to verify temperature integrity and may determine that replacement or destruction is required.
You agree to provide accurate and complete personal, health, prescription, payment and delivery information; notify us of allergies, pregnancy, breastfeeding, relevant medical conditions and current medicines; use medicines only as prescribed or directed; not share, sell, transfer or misuse medicines; store medicines safely and away from children and animals; check the medicine label and contents when received; contact us immediately if something appears incorrect; follow pharmacist and prescriber advice; and seek urgent medical help if you experience serious symptoms or adverse effects.
You consent to us contacting you by phone, SMS, email or other electronic means about your pre-screening, booking, consultation, prescription, delivery, payment, medication safety or related health service.
Electronic communication may not be fully secure. Do not send sensitive information unless you are comfortable using that method.
We may send administrative or clinical messages related to your care. Marketing messages will only be sent where permitted and you may unsubscribe where applicable.
If you create an account or patient login, you are responsible for keeping your login details secure and for notifying us promptly if you suspect unauthorised access.
We may suspend or restrict access if we suspect misuse, unauthorised access, security risk, fraud or breach of these Terms.
You must not use this website to obtain medicines unlawfully, submit false or misleading information, impersonate another person, alter or misuse prescriptions, obtain medicines for resale or diversion, interfere with website security, upload malicious code, harass or abuse staff, or do anything unlawful or unsafe.
This website may link to or use third-party booking platforms, clinical systems, payment providers, SMS providers, delivery providers, pharmacy systems, analytics tools or external resources.
We are not responsible for third-party websites or services except to the extent required by law. Your use of third-party services may also be subject to their own terms and privacy policies.
Unless otherwise stated, website content, design, text, graphics, branding, forms, workflows and other materials are owned or licensed by KyHealth. You may use the website for personal, non-commercial health service purposes only.
You must not copy, reproduce, adapt, scrape, reverse engineer or commercially exploit website content without our prior written consent, except where permitted by law.
To the maximum extent permitted by law, we are not liable for loss arising from misuse of medicines, failure to follow professional advice, incorrect information supplied by you or another person, delays outside our reasonable control, third-party system outages, courier delays or failures subject to consumer law rights, unauthorised account access caused by failure to protect login details, or website interruptions or errors.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right, professional obligation or liability that cannot lawfully be excluded.
We may update these Terms from time to time. The updated version will apply from the date it is published on the website.
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.
